Authorized Economic Operator (AEO)

What is AEO

AEO is the abbreviation of Authorized Economic Operator which the World Customs Organization WCO has defined as An organization or a company involved in the movement of goods certified by Customs of each country that such organizations or companies have complied with WCO or equivalent supply chain security standards. Authorized Economic Operators include manufacturers, importers, exporters, customs clearance agents, carriers, consolidators, port owners, airport owners, port or airport operators, warehouse owners and goods distribution agents.

The Customs Department has fully realized to conform with the WCO Framework of Standard to Secure and Facilitate Global Trade (SAFE) and to enhance the competitiveness of international trade, including complementing the business community in supply chain to emphasize the significance of safety in business transaction. The Customs Department has introduced the use of criteria, conditions and privileges of standardized AEO operators in order to facilitate more speedy clearance and obtain more customs privileges.

Privileges of Authorized Economic Operator (AEO)

  1. Privileges on customs procedures covering import, export and re-export;
  2. Tax privileges to be granted on more speedy tax refund and compensation;
  3. Privileges on using guarantee as standardized Authorized Economic Operator in lieu of placing a guarantee on transshipment and transit;
  4. Privileges on legal cases under the conditions specified by the Customs Department;
  5. Exports will be recognized by foreign Customs Administrations having Mutual Recognition Agreement so-called MRA ;
  6. Other qualified privileges will be announced by the Director-General of Customs.
The Customs Department has classified entrepreneurs of the AEO standard into two categories as follows:

  • Importer and Exporter of AEO standard in accordance with Customs Announcement No. 12/2556
  • Customs Clearance Agent of AEO standard in accordance with Customs Announcement No. 13/2556

Qualifications of Importer and Exporter of AEO Standard

  1. Must be a registered juristic person registered in Thailand with paid-up registered capital of at least five million baht;
  2. Have a stable financial status by considering from financial statements submitted to the Ministry of Commerce and certified by the auditor that the business transaction has retroactively earned profits for the past two consecutive years; and financial status must be certified by the Federation of Thai Industries; or by the Thai Chamber of Commerce and Board of Trade of Thailand; or the Thai Chamber of Commerce; or the Thai National Shippers Council; or the Thai Airfreight Forwarders Association (TAFA); or the Thai Gold Card Importer and Exporter Association (TGCA);
  3. Doing import or export business for at least three years and having readiness to pass through customs procedures by electronic system in accordance with the criteria stipulated by the Customs Department or using services of customs clearance agent of AEO standard or used to use services of licensed customs broker;
  4. Never have any records of customs offences in accordance with Section 27 of the Customs Law B.E. 2469 or offences on falsification of documents and using falsified documents in accordance with the Penal Code, and the legal case has been finalized by retroactively checking the records not exceeding three years from the date of application as importer and exporter of AEO standard;
  5. Have a control plan, and a risk assessment and management system for the security in business operation under the guidelines of supply chain security;
  6. Have a proper business premise and head office situated at the premise registered with Department of Business Development, Ministry of Commerce;
  7. Have never been revoked the status of importer and exporter of AEO standard in the past three years from the date of application.

Application as Importer and Exporter of AEO

Standard Importer and exporter who wish to be an importer and an exporter of AEO standard can submit an application form to the Registration and Customs Privileges Division, the Customs Standard and Valuation Bureau.

Customs Clearance Agent of AEO Standard

  1. Must be authorized by the Customs Department to be a customs clearance agent or an authorized customs clearance agent of special level in accordance with Customs Announcement No. 76/2552 dated 14 October B.E. 2552;
  2. Must be a juristic person registered in Thailand with paid-up registered capital of no less than one million baht;
  3. Be a member of any association dealing with customs clearance approved by the Customs Department of no less than three years;
  4. Have a stable financial status by considering from the business performance of the financial statement submitted to the Ministry of Commerce as stipulated by the Ministry of Commerce and certified by an auditor that business has earned profits continuously for the last three accounting periods;
  5. Never have any record of customs offences in accordance with Section 27 of the Customs Law B.E. 2469 or offences on falsification of documents and using falsified documents in accordance with the Penal Code, and the legal case has been finalized by retroactively checking the records not exceeding three years from the date of application as a customs clearance agent of AEO standard;
  6. Have readiness to pass through customs clearance by electronic system in accordance with the criteria specified by the Customs Department;
  7. Have at least one customs specialist certified by the Customs Department and have the staff or employees registered as customs clearance operators in suitable numbers to the amount of works of such customs clearance agent;
  8. Have a control plan, and a risk assessment and management system for the security in business operation under guidelines of supply chain security;
  9. Have a proper business premise for operation as a customs clearance agent and situated at the premise registered with the Department of Business Development, Ministry of Commerce;
  10. Have never been revoked the status of customs clearance agent of AEO standard in the past three years from the date of application.

Application as Customs Clearance Agent of AEO Standard

A customs clearance agent who wishes to be a customs clearance agent of AEO standard can submit an application to the Registration and Customs Privileges Division, the Customs Standard Procedures and Valuation Bureau.

Project of Authorized Economic Operator (AEO) is the project aimed at facilitating international trade to be speedy, cost-saving and time-saving. The AEO project is globally recognized by trading partners of Thailand in Asia, Europe or America. So far, Customs Administrations in Asia such as Japan and Republic of Korea have shown their interests to mutually accept Mutual Recognition Agreement (MRA) with the Thai Customs Administration as one way to facilitate international trade for Thai entrepreneurs who are trading partners with such countries.
