Express Consignments

EXPRESS CONSIGNMENTS
With the pace of modern business accelerating day by day, demand for faster delivery of consignments increases considerably. The needs of traders for expeditious clearance can no longer be met by regular Customs procedures. In response to these demand trends, Thai Customs developed a set of clearance procedures to assist both Customs and trade with expediting the clearance of large number of small value goods that are carried by express operators. In addition, Thai Customs also issues the Customs Notification No 68/2551: Automated Customs Procedures for Express Consignment to enable Customs to combine immediate release with relevant and appropriate controls for these consignments. Out of this, an automated system is designed accordingly to facilitate and control the clearance of express consignments.

According to the Customs Notification No. 68/2551, Thai Customs generally grants immediate release/clearance to all consignments, provided that the conditions laid down are met and that the necessary information required by national legislation is communicated at a stipulated time before the consignments arrive/depart. The advance communication of that information is facilitated, in particular, through electronic exchange of data.

However, Customs retains the right to carry out spot or other checks using risk management techniques and may require operators to provide facilities for Customs officers where special attendance or attention is required to apply the procedure. It must also be borne in mind that the facilities granted to operators by Customs are based on mutual trust and on compliance with the procedures and conditions laid down.

EXPRESS OPERATORS
Qualifications of Intending Express Operators
Intending express operators are required to submit a request to Customs and meet the following criteria:

  • A legal person with a paid-up capital register above 5,000,000 baht;
  • Employ at least 1 Customs certified broker; and
  • Have no record of committing offences under Customs and related laws in the past two years from the date of submitting the request, except those considered minor mistakes.
Eligibility Criteria for Express Operators
Thai Customs only considers applications from qualified express operators that are able to demonstrate that they are able to address the identified criteria as listed below:�

  • Automated system as specified by Customs must be in place to transmit advance consignment information;
  • Express operators must be able to categorize the consignments and follow the risk management criteria for selective inspection of consignments;
  • Automated system as specified by Customs must be in place to process Customs procedures for express consignments; and
  • Security of which amount not less than 2,000,000 baht, in a form of a bank guarantee or other forms as agreed by Customs, must be placed with Customs.
Qualified express operators may submit an application to be granted express operator status at the Registration and Privileges Sub-Division, Customs Standard Procedures and Valuation Bureau at the Customs Headquarters, Tel. 02-667-7983, 02-667-7802 to 3.
Please also note that the qualified express operators are required to run a pilot test of automated system for information exchange and processing Customs procedures with Customs.

"De Minimis" �Value

Thai Customs has specified the minimum value of consignments below which no duties or taxes will be levied or what is commonly known as a "de minimis" �value. Under the "de minimis" �threshold, postal items or express consignments with CIF value not exceeding 1,500 baht are allowed to be imported free of tax and duty. The underlying concept of "de minimis" �is that below a certain threshold, it is not economic to expend resources and time to collect low amounts of taxes and duties. In addition, this is designed to cut down the workload of Customs in chasing small amounts of duties and taxes, and to speed up clearance procedures.

Categories of Express Consignments�

Imported Express Consignments
To assist Thai Customs in determining data requirements and the exact procedure to be applied, imported express consignments being presented for immediate release are divided into four categories.

    • Category 1: Non-Dutiable Documents: This category comprises correspondence and documents having no commercial value and which are not subjected to duties and taxes under Part II of the Customs Tariff Decree B.E. 2530. Any items that are prohibited or restricted are not included.
    • Category 2: Non-dutiable Consignments: This category comprises :
      • (a) Consignments not subjected to duties and taxes under Part II of the Customs Tariff Decree B.E. 2530. Any items that are prohibited or restricted are not included.
      • (b) Low-value consignments, imported via an airport, of which CIF value does not exceed 1,500 baht and which are exempted from applicable taxes and duties under Part IV, Heading 12 of the Customs Tariff Decree B.E. 2530. Any items that are prohibited or restricted are not included.
      • (c) Trade samples of no commercial value which are exempted from applicable taxes and duties under Part IV, Heading 14 of the Customs Tariff Decree B.E. 2530. Any items that are prohibited or restricted are not included.
    • Category 3: Dutiable consignments of which FOB value not exceeds 40,000 baht. Any items that are prohibited or restricted are not included.
    • Category 4: Other consignments than those under Category 1, 2, and 3.

Exported Express Consignments
Similar to the import express consignments, the export express consignments being presented for immediate release are divided into two categories as follows:

    • Category 1 : Non-Dutiable Documents :�This category comprises comprises correspondence and documents which are not subjected to duties and taxes under Part III of the Customs Tariff Decree B.E. 230 Any items that are prohibited or restricted are not included.
    • Category 2 :�This category comprises :sssss
      • Non-dutiable consignments under Part III of the Customs Tariff Decree B.E. 2530 of which the invoice value not exceeding 500,000 baht/invoice:
      • Any items that are not prohibited or restricted;
      • Goods not intended for requesting tax and duty incentives under a free zone and bonded warehouses scheme, duty drawback under Section 19 bis scheme, or free trade zone scheme;
      • Goods not intended for requesting other tax and duty incentive schemes e.g. duty drawback under Section 19 (re-export), duty compensation, investment promotion, etc.; and
      • Goods not intended for requesting tax and duty exemption under Part IV of the Customs Tariff Decree B.E. 2530
    • Category 3 :�Other consignments than those under Category 1 and 2.

IMPORT PROCEDURES
Recognizing that working under a paperless environment could significantly reduce the costs of doing business, Thai Customs has introduced automated clearance system, applying ebXML (electronic business using eXtensible Markup Language) as a standard message on 1 January 2007. Most Customs clients e.g. brokers, importers/exporters, etc. react favorably to such reform and modernization of Customs procedures.

However, as the volume of indirect e-commerce grows, the increase in small consignments delivered via express carriers posts challenges to the clearance procedures of express consignments. In response to this demand, automated clearance of inbound express consignments will be introduced in the near future to assist both Customs and trade with expediting the clearance of large number of goods that are carried by express operators.

In the meantime, Thai Customs has provided simplified import procedures for inbound express consignments as follows :

  • Transmission of Pre-Arrival Express Manifest : Prior to the flight arrival, manifest data is downloaded into the operator's in-house system from their overseas offices. The operators then upload the manifest data into their local system then prepare Pre-Arrival Express Manifest and transmit it to Customs automated system at least 2 hours prior the arrival of the consignments, using ebXML via the VAN.
  • Check and Verification : As soon as the Customs computer system receives the Pre-Arrival Express Manifest data such data is preliminary validated. In cases �where the validated data contains no error, the Inbound Express Consignment Receipt Number is generated. The response message, then, is transmitted to the express operators. However, in case where the validated data contains error, an error message will be send back to the express operators. In addition, Customs officers will review the given Pre-Arrival Express Manifest data through pre-determined risk profiles and determine a status for the various consignments. Then, Express Inbound Consignment Declaration will be made by the express operator.�
  • Consignment Inspection and Release : At this stage the express operators bring the consignments and the Express Inbound Consignment Declaration with relevant import documents, such as Air Waybill, invoice, packing-list, etc., to the import Customs office for inspection. Customs check the Import Declaration and all relevant documents against the data in the Customs automated system. The consignments classified under the Red Line are physically checked. Once the inspection is completed and release is granted, the response message is forwarded to the express operators. The express operators then can print the permit document out from the system for the release.
EXPORT PROCEDURES
Unlike the import procedures for express consignments, the export procedures for express consignments are, at the moment, fully automated and known as e-Express . Customs clearance procedures for outbound express consignments are divided into 2 stages, those prior to the departure of consignments and those after the departure of the consignments.

Customs Procedures Prior to the Departure of Consignments

Similar to the general e-Export system, once the export declaration data has been entered into the Customs computer system it will be subjected to automatic processing, for example data validation, data matching, release status, etc. and the cargo is released. Generally, the export declaration and clearance process include 3 stages:

  • Transmission of Pre-Arrival Express Manifest : The first stage starts with express operators prepare Pre-Arrival Express Manifest and transmit it to Customs automated system at least 2 hours prior to the departure of the consignments, using eb-XML via the VAN.
  • Check and Verification : The second stage is the check and verification of the manifest made by the express operators. As soon as the Customs computer system receives the Pre-Arrival Express Manifest data, such data is preliminary validated. In cases where the validated data contains no error, the Outbound Express Consignment Receipt Number is generated. The response message, then, is transmitted to the express operators. However, in case where the validated data contains error, an error message will be send back to the express operators.
In addition, the given Pre-Arrival Express Manifest data is further screened against predetermined selectivity criteria (risk management system) in order to indicate whether the declaration is under a Red Line (requiring thorough physical checking) or a Green Line (permission of release). The feedback message is automatically generated and sent back to the express operators within the set of time. Then, the response message is forwarded to the express operations. The express operations then prepare and forward the Urgently Request for Express Exportation to Customs automated system, using ebXML via LAN. As soon as the Customs computer system receives the Urgently Request for Express Exportation data, such data is validated. In cases where the validated data contains no error, the number for the Urgently Request for Express Exportation is generated. The response message, then is transmitted to the express operators. However, in case where the validated data contains error and error message will be send back to the express operators.

  • Consignment Inspection and Loading: The third stage is the inspection of the consignments, classified under Red Line. At this stage the express operators bring the consignments and the Urgently Request for Express Exportation to the export Customs office for inspection. The customs officers check the Urgently Request for Express Exportation agents the data in the Customs automated System. Once the inspection is completed, the express operators load the consignment onto the airplane.

The express operators then print out the Request for Express Exportation with its number and load the consignments onto the air plane.

Customs Procedures after the Departure of Consignments

  • Transmission of Express Outbound Consignment Declaration: Express operators prepare the Express Outbound Consignment Declaration and transmit it to Customs automated system within 24 hours after the departure of the consignments, using eb-XML via the VAN.
  • Check and Verification: The second stage is the check and verification of the Declaration made by the express operators. As soon as the Customs computer system receives the Express Outbound Consignment Declaration data, such data is preliminary validated. In cases where the validated data contains no error, the number of the Express Outbound Consignment Declaration is generated. The response message, then, is transmitted to the express operators. In case where the validated data contains error, an error message will be also send back to the express operators.
The express operators then print out the Consignment Movement Control Form with its number and contact Customs to write of the Consignment Movement Control Form in the Customs automated system. The response message is automatically generated and sent back to the express operators.
